Terms and Conditions

By accessing the Platform and Services, You represent that:

• You are 18 years of age or older and an Indian citizen.
• You are capable of entering into a legally binding agreement.
• You have the right, authority, and capability to enter into this Agreement and abide by all provisions of these Terms and Conditions.
• You are not impersonating any person or entity, or falsely stating your age or affiliation.
• The mandatory information and Officially Valid Document(s) (OVD) provided by You are true, correct, and belong to You.
• You have the legal ability to use this Platform and its Services, including purchasing/selling gold and silver, availing loans against mutual funds, and are capable of being bound by these Terms and Conditions.
• You are not registered under the Goods and Services Tax Act, 2017. If You become GST-registered during Your use of our Platform, You shall inform Us in writing immediately.
• You shall seek independent tax advice where necessary; these Terms and Conditions do not constitute tax advice.

Discvr.AI reserves the right to terminate or suspend Your access in case of any incorrect representation of the above conditions.

3.1 Authentication Methods: We provide secure user authentication through Gmail login OTP-based verification systems.

3.2 Account Responsibility: You are responsible for maintaining the confidentiality of Your account credentials and for all activities that occur under Your account.

3.3 Registration: You must provide accurate and complete information during registration and keep Your account, KYC details, and contact information updated at all times. If We have reasonable grounds to suspect that any information is untrue, inaccurate, or incomplete, We may suspend or terminate Your account.

3.4 Terms Acceptance: By completing the login process, You acknowledge that You have read, understood, and agree to be bound by these Terms and Conditions.

5.1 Platform Role: Discvr.AI acts as a platform facilitating access to loan against mutual fund services. The actual lending is provided by Our Lending Partner(s), who operate in partnership with NBFC(s) regulated under applicable Indian law.

5.2 No Direct Lending: Discvr.AI does not disburse loans directly. We facilitate the connection between You and Our Lending Partner. The loan agreement, terms, interest rates, tenure, and repayment conditions are between You and the Lending Partner/NBFC.

5.3 Separate Terms: By availing loan against mutual fund through the Platform, You expressly agree to be bound by the terms and conditions of the Lending Partner and the relevant NBFC, as may be amended from time to time. A link to such terms will be provided on the Platform where applicable.

5.4 Eligibility and Approval: Loan eligibility, approval, disbursement, and servicing are at the sole discretion of the Lending Partner/NBFC. Discvr.AI does not guarantee loan approval or any specific terms.

5.1 Liability: Discvr.AI shall not be liable for any aspect of the loan, including but not limited to rejection, delay, default, interest, foreclosure, or any dispute between You and the Lending Partner/NBFC.

6.1 Platform Role: Discvr.AI provides a platform facilitating buying, selling, SIP, and ancillary services related to gold and silver in partnership with Augmont GoldTech Private Limited ("Augmont"). Augmont is the bullion provider and provides services of safe keeping/vaulting and delivery/fulfilment of gold and silver.

6.2 Augmont Terms: In addition to these Terms and Conditions, by accessing or using the Platform and availing the Digital Gold and Silver Services, You expressly acknowledge and agree to be bound by the terms and conditions of Augmont, as may be amended from time to time ("Augmont T&Cs"), available at: https://www.augmont.com/terms-conditions. In case of any inconsistency between these Terms and the Augmont T&Cs, the Augmont T&Cs shall prevail solely with respect to Digital Gold and Silver Services.

6.3 SIP in Gold/Silver: Systematic Investment Plan (SIP) in gold and/or silver allows You to invest periodically. SIP terms, frequency, minimum amounts, and related conditions are subject to the Augmont T&Cs and as displayed on the Platform.

6.4 Liability: Discvr.AI's role is limited to providing a platform to facilitate transactions. We shall not be liable in any manner with respect to the products and/or services offered by Augmont or any other business partners.

6.5 Authorisation: You voluntarily and irrevocably authorise Discvr.AI to act as Your limited agent for facilitating Digital Gold and Silver Services, including interacting with Augmont and any custodian or third-party service provider for storage, redemption, or delivery of gold/silver.

7.1 Gold/Silver Services: Users availing Digital Gold and Silver Services may be required to provide KYC documentation and other information as deemed fit by Augmont, particularly for preventing fraudulent activities and for delivery of gold/silver. KYC verification is primarily based on PAN Card, with provisions for Form 60 if no PAN Card is available.

7.2 Loan Against Mutual Fund: KYC and verification requirements for loan against mutual fund shall be as prescribed by the Lending Partner and NBFC.

8.1 Invitation to Offer: The market prices of bullion shown on the Platform are an invitation to offer. An order legitimately placed by an eligible account holder constitutes an offer for purchase or sale.

8.2 Pre-payment: You can purchase gold/silver on a pre-payment basis. Applicable GST (e.g., 3% on gold purchases as per prevailing law) shall apply. Gold/silver once purchased may not be sold before 48 hours of purchase, as per Augmont T&Cs.

8.3 Order Confirmation: Once payments are received and KYC (where applicable) is acceptable, Augmont shall issue an invoice confirming the order within the period specified in the Augmont T&Cs.

8.4 Rejection: Discvr.AI and/or Augmont reserve the right to delay, reject, suspend, or cancel any transaction including due to technical errors, market volatility, system downtime, or suspected fraudulent activity. Refunds shall be processed in case of order rejection as per applicable terms.

8.5 Limits: Minimum and maximum purchase, sale, or delivery limits per User may be prescribed and modified at Our sole discretion.

8.6 Cancellation: Once an order is placed and payment confirmed, You are not entitled to cancel such order, except as permitted under the Augmont T&Cs or in case of payment failure.

8.7 Storage and Title: Gold/silver purchased by You shall be stored with the Custodian on Your behalf. Title passes to You upon storage in the vault as per Augmont T&Cs. All digital gold/silver purchased remains Your sole property.

11.1 Physical Delivery: You may request physical delivery of gold/silver by logging into Your account and utilising Your digital balance. Applicable charges and delivery terms are as per the Augmont T&Cs.

11.2 Address and Verification: You must provide a valid delivery address and any documents/identification specified. The recipient must produce identity proof at the time of delivery.

11.3 Examination: Recipients should carefully examine the package before accepting. Do not accept deliveries where packaging has been tampered with or contents are damaged. Upon signing the delivery receipt, the recipient acknowledges receipt and the Company is not liable for subsequent complaints.

11.4 Non-Delivery: If the recipient is not available, the courier may attempt delivery as per standard practice. Re-shipment and handling costs for non-delivery may be chargeable to You.

12.1 Pricing: Prices displayed on the Platform for gold/silver are linked to spot market prices as indicated by Augmont. Discvr.AI reserves the right to modify the reference pricing mechanism at any time.

12.2 Payment Methods: Payment will be accepted through the payment options made available on the Platform, which may include payment gateways and UPI.

12.3 Taxes: All applicable taxes, duties, levies, or cess on the purchase, sale, delivery, or transfer of gold/silver shall be borne by You. You are solely responsible for personal income reporting and tax payments as required by law.

12.4 GST and TDS: You confirm that You are not a GST-registered dealer. TDS may not be applicable for financial transactions on the Platform as per prevailing law; You are responsible for compliance.

13.1 Binding Payment: Upon confirmation of the payment, You shall be permitted to withdraw the amount after 48 (forty-eight) hours of making such purchase, and there is no minimum lock-in period. Once payment has been confirmed, the same shall be binding and cannot be cancelled.

13.2 SIP Opt-out: You can pause or delete gold/silver SIP/auto-investing through the options provided on the platform under your portfolio in "Active SIPs" .

13.3 Coupons/Discounts: On use of any coupon or discounts, as made available by us on the Platform or any other website or platform of any authorised third party, for purchase of Precious Metal, the same shall be verified and adjusted, as may be necessary, within 7 (seven) days of use of such coupon or discount.

13.4 Refund Policy: once an order for purchase or sale has been confirmed by You, refunds or cancellation is not possible. All orders are final upon Your confirmation. However, in the event of a withdrawal failure, if the sale proceeds are not credited to your bank account within 24 hours, the equivalent quantity of gold sold shall be automatically reinstated to your account within 10 days from the date of such failure.

14.1 Nature and Purpose

Polls, quizzes, streaks, and similar engagement activities ("Engagement Activities") are conducted solely for user engagement, financial literacy awareness, and platform interaction purposes. They are promotional activities and do not constitute gambling, betting, lottery, prize competition, or games of chance under applicable Indian laws.

14.2 No Consideration / No Entry Fee

• Participation in Engagement Activities is completely voluntary and free of cost.
• No entry fee, subscription fee, purchase requirement, deposit, staking of money, or financial consideration is required to participate.
• Participation in bullion transactions, mutual fund services, or loan products is not a condition for participation.

14.3 Skill-Based / Non-Chance Structure

• Where quizzes or knowledge-based questions are involved, rewards (if any) are determined on the basis of objective, knowledge-based responses and/or predefined engagement milestones.
• No reward is allocated purely on the basis of random draw, lottery, or chance-based selection involving paid consideration.

14.4 Non-Monetary Promotional Credits

Any benefits provided (including small denomination digital gold or silver credits typically ranging between ₹10 to ₹100) are promotional in nature, non-transferable, non-withdrawable as cash, not redeemable for legal tender, and subject to platform usage conditions.

14.5 No Investment Return Representation

Rewards under Engagement Activities do not represent investment returns, assured income, yield, interest, or cashback on financial products.

14.6 No Guarantee of Reward

Participation does not guarantee any reward. The platform reserves the right to modify, suspend, or discontinue any Engagement Activity at its discretion.

14.7 Geographic Restrictions

Engagement Activities may not be available in certain Indian states where promotional gaming regulations impose restrictions. The platform reserves the right to restrict participation from such jurisdictions.

14.8 Fair Use and Anti-Abuse

The platform reserves the right to disqualify users in cases of fraudulent participation, multiple account misuse, automation/bot usage, or manipulative behavior.

14.9 Data and Privacy

Poll participation does not require submission of additional personal data beyond registered account information. Any data collected will be processed in accordance with the platform’s Privacy Policy and applicable data protection laws.

14.10 No Association with Apple or Third Parties

Apple Inc., Google LLC, or any other platform provider are not sponsors, administrators, endorsers, or participants in these Engagement Activities.

16.1 License: We grant You a limited, non-exclusive, non-transferable, royalty-free license to use the Platform for availing the Services.

16.2 Prohibited Activities: You shall not:

• Copy, reproduce, sell, redistribute, publish, or exploit any content from the Platform except for personal, non-commercial use
• Damage, disable, or impair the Platform or interfere with other users' use
• Remove any copyright or proprietary notices
• Publish gold/silver prices or Platform information on other mediums for commercial purposes
• Rely on Platform data as investment advice; You are solely responsible for investment decisions
• Attempt to gain unauthorised access to Our systems, upload malicious content, misrepresent identity, use the Platform for illegal or fraudulent activities, or reverse engineer the Platform

17.1 DPDP Act 2023: We are committed to full compliance with the Digital Personal Data Protection Act, 2023, and all applicable Indian data protection regulations.

17.2 IT Act: Our platform adheres to the Information Technology Act, 2000, and all subsequent amendments and rules.

17.3 Processing: We process Your personal data only for legitimate purposes as outlined in our Privacy Policy and with Your explicit consent.

17.4 Data Rights: You have the right to access, correct, delete, and port Your personal data as per applicable laws.

17.5 Cross-Border Transfer: Any cross-border data transfers will be conducted in compliance with Indian data protection laws.

18.1 Security Measures: We implement enterprise-grade security measures including end-to-end encryption, encrypted storage, multi-factor authentication, regular security audits, and disaster recovery procedures.

18.2 Retention: We retain Your data only as long as necessary for the purposes outlined in these terms or as required by law.

18.3 Security Incidents: In the event of a security breach, We will notify affected users and relevant authorities as required by applicable laws.

19.1 By Us: Discvr.AI reserves the right to modify, suspend, or terminate access to the Platform or any Service at any time for any reason, including breach of these Terms. Termination may be affected without prior notice.

19.2 By You: You may request termination of Your account by deleting Your account or sending an email to customer support from Your registered email.

19.3 Effect: On termination, Your account may be deactivated and related information deleted. We shall not be liable to You or any third party for termination.

19.4 Gold/Silver Balance: In case of termination, Your gold/silver balance and loan obligations shall be handled as per the Augmont T&Cs and the Lending Partner's terms respectively.

20.1 Service Availability: We do not guarantee uninterrupted service and are not liable for temporary outages or maintenance periods.

20.2 Financial Losses: We are not liable for any financial losses resulting from investment decisions, gold/silver price volatility, loan default, or any transactions on or through the Platform.

20.3 Third-Party Services: We are not responsible for the performance, availability, or conduct of Augmont, the Lending Partner, NBFCs, payment gateways, or any other third-party services.

20.4 No Consequential Damages: In no event shall Discvr.AI be liable for any indirect, consequential, incidental, special, or punitive damages including loss of profits, business interruption, loss of data, or economic interests.

20.5 Aggregate Liability: Our aggregate liability under these Terms shall not exceed the commission or fees received by Discvr.AI for the specific transaction giving rise to such liability, if any.

20.6 Gold/Silver Prices: Gold and silver prices are based on prevailing market rates, are volatile, and no return or performance is guaranteed.

27.1 We may add or remove features, modify limits, or discontinue services at any time. Such changes may also result from discontinuation by third-party partners.

27.2 Any content downloaded through the Platform is at Your own risk. We do not warrant that such content is error-free or virus-free.

27.3 The Services are provided "as is" and "as available." We make no warranty that the Services will meet Your requirements, be uninterrupted, or error-free. You are responsible for evaluating the accuracy and usefulness of the Services.
